What are the Leek BS conveyancing panel arrangements?
Unlike the CML the Building Society Mortgage Instructions deal with this. Section A.12 states ‘In order to act on our behalf your firm or company must be a member of our conveyancing panel provided we are a society that operates one – see specific requirements for details of our arrangements. The Special Requirements state:

The Society’s approved solicitor panel manager is Legal Marketing Services (LMS). This can be accessed via the LMS web portal www.lms.com

I am on the Leek BS conveyancing panel. Can I get an archived copy of Leek BS Specific Requirements from the BSA?
The BSA, as is the case with the CML do not hold data sets of Specific Requirements. We would recommend you contact Leek BS direct.
Are the BSA planning on creating a search tool with a view to list solicitors on the Leek BS conveyancing panel ?

Is it true that the Law Society has advised that firms check their status on the Leek BS conveyancing panel?
The Scottish Law Society has suggested that solicitors should check their panel status with lenders prior to accepting client instructions to act. The advice is lender-agnostic as it does not relate specifically to solicitors on the Leek BS conveyancing panel. The suggestion arises from the practice of a number of mortgage lenders who remove solicitors from their panels without prior notice as part of their panel management system, which can lead to some solicitors discovering this only once instructed. This is sensible advice as a client finding out midway through a transaction that their lawyer is not on the approved lender panel is very frustrating and can lead to complaints. My client is purchasing a new build house for £835,250 in Newcastle requiring a mortgage advance over GBP 415k. I am on the Leek BS conveyancing panel but do Leek BS have a separate approved panel when the advance is above 350k?
Lexsure only know of a couple of banks that operate a distinct approved solicitors panel where the mortgage advance is over a certain level. You should nevertheless check directly with Leek BS. At one stage HSBC would only allow Sole practitioners to act for them where the mortgage was below £150,000. We are not sure if HSBC still operate such a condition. In your case it is best to check with Leek BS
A recent SRA survey reveals that three quarters of solicitors have been removed or threatened with removal from a lender conveyancing panel. Leek BS and other building societies have restricted their panel over the years. Why?
The feeling from lenders generally (we can not speak for Leek BS specifically), is that for too long solicitors have concentrated on their duty of care to their purchasing client, and have paid scant attention to the duty they owe to the lender, whom they conveniently forget is also their client.

Looking from the lenders’ perspective, it has to be said that there are pressures to encourage smaller panels. The Financial Services Authority regards the open panel system as a major contributor to mortgage fraud and negligence cases, and has been leaning on lenders to move to proactive panel management, which is more expensive the larger the panel. Participation on the lender's panel of conveyancers is at the absolute discretion of the the lender. The days of open panels are now long gone. Many lenders reserve the right to accept or reject any application without giving any reason. You should check your original application to join the Leek BS conveyancing panel to see if you are entitled to a reason.
