What are the Leek BS conveyancing panel criteria?
Unlike the CML the Building Society Mortgage Instructions deal with this. Section A.12 states ‘In order to act on our behalf your firm or company must be a member of our conveyancing panel provided we are a society that operates one – see specific requirements for details of our arrangements. The Special Requirements state:

The Society’s approved solicitor panel manager is Legal Marketing Services (LMS). This can be accessed via the LMS web portal www.lms.com

You must also comply with the terms and conditions of your Leek BS solicitor panel appointment.

What is the CLC doing to protect licensed conveyancers from being removed from lender panels?
As is the case with the Law Society the CLC has entered discussions with lenders and their representative bodies to see whether and how the risks that lenders wish to mitigate could be addressed through the regulatory framework rather than ad hoc arrangements that can differ from lender to lender. We expect that that the CLC have been in touch with lenders such as Leek BS since 2008 which is when lenders started being more restrictive
Theoretically Leek BS could request or audit my files as I am on the Leek BS conveyancing panel. Are there any confidentiality issues that I need to consider first?
We can't comment specifically on Leek BS. Many major lenders are now introducing ‘file auditing’ as standard practice in relation to completed matters. This raises questions of confidentiality in relation to the buyer client and the purpose to which the results of such audits will be put. The starting point is to remember that the file does not belong to your firm, it belongs to the ‘client’. But, of course, we will normally have two clients – the buyer and the lender - and you will owe a duty of confidentiality to each. So basically, you have to separate the file and just send the lender the parts solely relating to themselves. But, of course, as this will basically be correspondence with the lender, mortgage instructions etc.

Check with your Compliance Officer, but a firm should not send the complete conveyancing file without the borrower client’s express consent – and if he is in dispute with the lender he is hardly likely to agree. However, if the lender can establish a prima facie case of fraud, then you may be under an obligation to disclose the whole file.

The emerging convention is that lenders are including an authority to disclose in loan application forms to counter this problem. Mortgage Express v Sawali, 2010 EWHC 3054 (Ch) indicates that such provisions valid? Please click here for more information about that case.

What reports are available via COMPLETIONmonitor to assist my application to be on the Leek BS conveyancing panel?
There are many reports available but examples include:
  • Average time frame to register charges at the Land Registry
  • Average time frame to send deeds to the lender (calculated from completion date or title registration)
  • Number of conveyancing cases by lender
  • The percentage of the firm’s business which is conveyancing (purchase and remortgage)
  • Average mortgage advance
  • Buy to Let transactions
  • Notification to Lender analysis indicating frequency and nature of disclosures - to include benchmarking analysis against aggregate data
  • Evidence of undertaking logs
  • Current and historic missed priority dates
  • Analysis as to the nature of clients (e.g. new client )
My firm is not on the Leek BS solicitor panel as well other banks . My clients, who have applied for a mortgage with Leek BS still want me to act for them regardless of the fact that we are not on the Leek BS panel. Is it fine for me to use a local to represent Leek BS on mortgage aspect of the transaction?
Please tread carefully here as what you are suggesting may not be acceptable to the mortgage company. It is possible that you (as a non-panel firm) or the mortgage applicant are not entitled instruct a panel firm of your choice. Lenders such as Nationwide BS make it clear to their panel firms that where a non-panel member firm is instructed by one of their mortgage applicants, the lender will appoint a panel firm to carry out its instructions and to liaise with the borrower's conveyancing firm. You also need to make the costs implications and potential for delay very clear to your client.
The firm that I work for is on the Leek BS conveyancing panel. I am dealing with Leek BS mortgage on a purchase. My borrower client is asking not to disclose an issue to Leek BS. What do I do in this conflict situation?
When a solicitor is acting for both Leek BS and borrower there is potential for conflicts to arise. You owe duties to both clients. All information received by you from your client is confidential and cannot be disclosed without the client’s consent.

In your situation, if the purchaser will not consent to the information being passed on to the lender, the solicitor must cease to act for Leek BS and it may well be prudent for you to cease to act for the purchaser as well. You must not inform Leek BS of the reason for termination of the retainer over and above the fact that a conflict has arisen. The fact that you can no longer act should alert even the most somnambulistic of lenders that something is wrong with the borrower and/or purchase. The fact that you have disinstructed yourself should not affect your Leek BS conveyancing panel status.

my firm’s membership of the Leek BS conveyancing panel was revoked but was reinstated on appeal, do I need to include this information on my application for CQS accreditation?
You should supply details of the date of removal, information on the reason for removal, date of appeal and any reason given for reinstatement. This should not adversely impact your application but gives the CQS team a complete picture of what has occured.
