On 1 December 2010, the CML published changes to the format and content of the Lenders’ Handbook.
Our cross-section of the changes to Part 2 is here. The form and renumbering changes are detailed in this document at the CML website. The content changes may be summarized as follows:
Part 1 introduction and section 1: references to rule 6 (3) of the Solicitors' Practice Rules 1990 have been removed. Instead there is reference to the Solicitors' Code of Conduct 2007.
Section A3 - if not familiar with the seller’s solicitors or conveyancers, the solicitor/conveyancer is now instructed by the lender to check their validity. Lenders are now able to stipulate in Part 2 whether they require notification of the name and address of the sellers’ solicitors/conveyancers, and if so, where this should be sent.
Section B3 - lenders can now stipulate in Part 2 whether they require notification of the name and address of the sellers’ solicitors/conveyancers, and if so, where this should be sent.
